Terms of Service

Welcome to MapMyMemories. These Terms of Service ("Terms") constitute a legally binding agreement between you ("User") and Federico Garzia ("we," "us," "our").

By accessing or using our website located at mapmymemories.xyz (the "Service"), you agree to be bound by these Terms. If you do not agree to all of these Terms, do not use the Service.

1. Service Provider

The Service is provided by a private individual.

2. Nature of the Service

MapMyMemories allows users to create customized travel route maps.

Freemium Model: Users can create maps and download a standard resolution image (72 DPI) free of charge. High-resolution downloads (300 DPI / 600 DPI) are available for purchase.

We reserve the right to modify the nature of the service, introduce or adjust fees, or discontinue the service at any time.

3. Intellectual Property

Your Content: You retain ownership of the travel data (routes, locations) you input.

Our Content: The visual design, source code, logo, and architecture of the Service are the exclusive intellectual property of the Owner. You agree not to reproduce, duplicate, copy, sell, or exploit any portion of the Service code or design without express written permission.

4. Payment Processing

Payments for premium features are processed by Paddle.com Market Ltd, which acts as our Merchant of Record. Paddle is the seller of record for tax and contractual purposes. All prices shown at checkout include applicable taxes (VAT/GST). MapMyMemories remains responsible for customer service, technical support, and product delivery.

5. License for Purchased Content

When you purchase a high-resolution map download, you are granted a personal, non-exclusive, non-transferable license to use the downloaded file. You may not:

  • Resell, redistribute, or sublicense the downloaded file.
  • Use it for commercial purposes without written permission.
  • Remove or alter any watermarks or attributions included in the file.

6. Digital Content Conformity (Directive 2019/770 / D.Lgs. 177/2021)

The digital content we supply must conform to the contract. This means it must correspond to its description and the preview shown before purchase, and be fit for the purposes for which digital content of the same type would normally be used.

In case of a lack of conformity manifested within 2 years of supply, you have the right to: (1) restoration of conformity (file regeneration at no charge), (2) a proportionate price reduction, or (3) contract termination with a full refund, according to the hierarchy established by law.

During the first 12 months, any lack of conformity is presumed to have existed at the time of supply. The burden of proof is on us to demonstrate otherwise.

These remedies apply regardless of any waiver of the right of withdrawal. For full details, see our Refund Policy.

7. Complaints and Alternative Dispute Resolution (ADR)

If you have a complaint about our service, please contact us first at support@mapmymemories.xyz. We aim to resolve all issues within 48 business hours.

For cross-border disputes within the EU, you may contact the European Consumer Centres Network (ECC-Net). You also have the right to use national ADR bodies pursuant to D.Lgs. 130/2015.

8. Prohibited Uses

You are prohibited from using the Service:

  • For any unlawful purpose.
  • To upload viruses or malicious code.
  • To "scrape" or collect data from our Service automatically.
  • To infringe upon our intellectual property rights.

9. Artificial Intelligence Disclaimer

MapMyMemories uses artificial intelligence (AI) to generate travel route suggestions based on your text descriptions. AI-generated content may contain inaccuracies, geographical errors, or references to locations that do not exist. You are solely responsible for independently verifying all AI-generated content before relying on it, exporting it, or publishing it.

We disclaim all liability for errors, omissions, or inaccuracies in AI-generated route suggestions, captions, or any other AI-assisted output. AI-generated suggestions are provided "as is" and do not constitute travel advice.

10. Third-Party Services and Content

The Service relies on third-party tools for mapping (Mapbox, OpenStreetMap), AI route generation (OpenAI), authentication (Firebase), payment processing (Paddle), and image sourcing (Wikimedia Commons). Your use of the Service is also subject to the terms of these providers. We make no warranties regarding the accuracy or availability of third-party services or data.

11. Disclaimer of Warranties

The Service is provided "AS IS" and "AS AVAILABLE".

We do not guarantee that the Service will be secure, error-free, or uninterrupted. We disclaim all warranties, express or implied, including any warranties of merchantability or fitness for a particular purpose. As this is a free tool, you use it at your own risk.

12. Limitation of Liability

To the maximum extent permitted by applicable law, in no case shall the Owner be liable for any direct, indirect, incidental, punitive, or consequential damages arising from your use of the Service, or for any claim related to the use of the Service or any content produced by it.

13. Governing Law

These Terms shall be governed by and construed in accordance with the laws of Italy. Any dispute relating to these Terms shall be submitted to the exclusive jurisdiction of the Court of Bolzano.

14. Copyright Complaints

If you believe that your copyrighted work has been used on our Service in a way that constitutes copyright infringement, please contact us at support@mapmymemories.xyz with the following information: (1) a description of the copyrighted work, (2) the location of the allegedly infringing content on our Service, (3) your contact information, (4) a statement of good faith belief that the use is not authorized, and (5) a statement, under penalty of perjury, that the information is accurate and that you are the copyright owner or authorized to act on behalf of the owner.
